On February 21, 2006, the City Council asked to consider an item pertaining to the release of a confidential legal opinion regarding the NBC Catalina Property as part of the one step-two step process.  The first step is to determine if Council would like to have a report placed on a future agenda.

On November 1, 2005, the City Council voted to consider the release of a confidential legal opinion prepared by the outside law firm of Shute, Mihaly & Weinberger. The action failed, as the vote for this item tied at 2-2. Council Member Gordon has requested to reconsider the release of this memo.  A copy of the prior staff report provided to Council is attached.

RECOMMENDATION:

Staff recommends that City Council determine if it would like the matter placed on a future agenda for consideration to release the confidential memo.
