Project No. 2006-105 was the subject of appeal hearings held before the City Council on February 6 and 20, 2007. The City Council passed a motion on February 20, 2007, to deny the appeal by a vote of 3 � 2 and directed the City Attorney�s Office to return with a resolution formalizing its action. Therefore, a resolution denying Project No. 2006-105, including Conditional Use Permit No. 2006-105, Variance and Development Review No. 2006-105, for a Whole Foods Market proposed for 901 W. Alameda Avenue is presented for Council consideration.
On February 20, 2007, the Council also directed staff to work with Whole Foods to identify suitable alternative sites for a possible Whole Foods store in Burbank. On March 6, 2007, the City received a letter from Whole Foods reporting on its inability to find suitable alternative sites and requesting further consideration of a 40,000 square foot store discussed by the Council during its deliberations for the store proposed at 901 W. Alameda Avenue. Given that the Council closed the appeal hearing and directed staff to return with a resolution formalizing its action denying the Whole Foods appeal, the Council would have to hold an additional noticed public hearing prior to considering a smaller project. The City Attorney�s Office recommends that public notice be done at the applicant�s sole expense and that the hearing not be scheduled until the revised project is submitted by Whole Foods.
The Council may, therefore, take either of the following actions:
1. Adopt �A RESOLUTION OF THE COUNCIL OF THE CITY OF BURBANK DENYING CONDITIONAL USE PERMIT NO. 2006-105, VARIANCE AND DEVELOPMENT REVIEW NO. 2006-105 (WHOLE FOODS MARKET).�
OR
2. Continue consideration of a 40,000 square foot Whole Foods store to a future date for a noticed public hearing, with all costs of such notice to be paid by the applicant.
