PURPOSE:
To appropriate funds already received from the City�s inmate pay telephone provider in the amount of $15,000.
BACKGROUND:
The California Penal Code, Section 4025, allows the City to deposit any money received from a telephone company or pay telephone provider that supplies phones to inmates, into an inmate welfare fund. The Penal Code states that the use of these funds can only be for the benefit, education, and welfare of the inmates confined in the jail.
ANALYSIS:
The Burbank jail currently has 16 phones for which it receives revenues. Inmate calls are made collect, and the City receives a percentage of the revenues. As of October 2006, the City of Burbank has received a total of $116,863 in inmate pay telephone revenues. At this time, Staff recommends using $15,000 of this money to provide newspapers, toothbrushes, and other items that will benefit the inmates.
FISCAL IMPACT:
Adoption of the proposed resolution will allow the City to appropriate pay telephone revenues already received. The General Fund will be amended by appropriating $15,000 from Account 001-ND000-30001-1017 to Account 001-PD03A-70011-0000-15247.
RECOMMENDATION:
It is recommended that the City Council approve a resolution appropriating these funds totaling $15,000.
