RESOLUTI0Ns APPROVING CONTRACT DOCUMENTS AND AWARDING A CONSTRUCTION CONTRACT FOR BID SCHEDULE nO. 1139, empire avenue Street improvement Project and Approval of a professional serviceS agreement for construction management services


 

Purpose

 

Staff is requesting City Council approval of resolutions related to Bid Schedule No. 1139, Empire Avenue Street Improvement Project.  These resolutions would:

 

1.      Approve contract documents and award a contract for construction for Bid Schedule No. 1139.

2.      Approve a Professional Services Agreement for construction management assistance.

 

Background

 

The Empire Avenue Street Improvement Project, Bid Schedule No. 1139, is the fourth and last segment of the Empire Avenue Transportation, Utility and Landscape Project also known as the �Empire Avenue Beautification� project.  The Empire Avenue Beautification project�s completed segments include:

 

Segment 1: Avon Street/Hollywood Way Connector (Completed October 2002)

  • Constructing a street to replace the existing alley

  • Resurfacing Avon Street

  • Signalizing the new intersection of Avon Street and Hollywood Way

  • Installing an underground street lighting system

  • Landscaping Avon Street and Empire Avenue (Avon Street to Hollywood Way)

Segment 2: Improvement of Empire Avenue, Buena Vista Street to Valpreda Street (Completed March 2003)

  • Resurfacing Empire Avenue

  • Constructing decorative stamped asphalt crosswalks at signalized intersections

  • Installing an underground street lighting system

  • Constructing landscaped median islands and planting parkway street trees with decorative tree well covers

Segment 3: Robert Gross Park Frontage Improvements (Completed June 2004)

  • Constructing new sidewalk with street trees

  • Replacing the existing chain-link fence with a decorative steel fence and pilasters

  • Installing a 110-foot-long masonry block wall for future signage to identify the park

  • Constructing a decorative iron gate at the driveway entrance

  • Landscaping behind the new sidewalk

Bid Schedule No. 1139, the last segment, which extends from Buena Vista Street to Clybourn Avenue (Exhibit A), will include a series of landscaped medians with irrigation; enhanced crosswalks; selected sidewalks, curb, and gutter reconstruction; ADA compliant pedestrian ramps; and new street trees, tree wells, and planters.  In addition, the roadway will be reconstructed by pulverizing the existing asphalt pavement and reconstructing the base (Pavement Reclamation), then capping it with new asphalt rubber hot mix (ARHM) pavement.  Traffic signal loops will be installed at the intersection of Ontario Street and Empire Avenue and at signalized intersections along Empire Avenue.

 

The project also includes a number of other improvements along Empire Avenue, including the removal of an abandoned rail-spur crossing near Ontario Street; construction of sidewalk, parkway drains, and a metal hand rail for pedestrian accessibility and protection adjacent to the spillway that drains to the Lockheed Channel.  In addition, improvements will be made to the storm drain system and an underground street lighting electrical system will be installed.

 

Analysis

 

The bid opening for Bid Schedule No. 1139 was held on April 18, 2006, and five (5) contractors submitted bids as follows:

Upon review of the bid documents, staff finds Shawnan to have submitted the lowest responsible bid of $3,521,158.50, which is 0.2% below the engineer�s estimate of $3,528,249.07.  Staff contacted the State of California Contractor�s State License Board and found Shawnan�s license to be current, active, and in good standing.  Staff also contacted several references, who provided confirmation that Shawnan had satisfactorily completed their projects.

 

In addition to the bid amount, staff recommends a reserve for contingencies for this project of approximately 10% or $352,000.00.  This contingency will allow staff to account for any incidental work, unforeseen field conditions that could be encountered during construction, and any resulting field modifications that may be necessary.

 

Construction of this project is planned to occur between June and November 2006.  The work is to be completed within 150 consecutive calendar days.  This project is considered categorically exempt under CEQA Section 15301(c).

 

Construction Management Selection

 

Due to the aggressive construction schedule and to maintain continuity of the project, staff recommends Tetra Tech, Inc. be awarded a contract for construction management services for $136,600.00.  Tetra Tech, Inc. completed the design and construction plans on the project and any discrepancies between design and actual field conditions can be quickly resolved.  The proposed amount is competitive for a project of this technical complexity and fast pace schedule.

 

Fiscal Impact

 

The total cost for construction, construction contingency, and construction management   services efforts is $4,009,758.50.  The City allocated $4,470,572.60 for Empire Avenue Beautification Project in account number 370.CD12A.70999.1177.  

 

Recommendation

 

Staff recommends that the City Council:

  1. Adopt the proposed resolution approving the contract documents and awarding a construction contract to Shawnan for Bid Schedule No. 1139, Empire Avenue Street Improvement Project.

  2. Approve a Professional Services Agreement for construction management services with Tetra Tech, Inc. for the amount of $136,600.00.
