PROCESS FOR AMENDING DEVELOPMENT AGREEMENTS:

 

Recommendation:

Staff recommends that the Council note and file this report.  If the Council wishes to provide input on the forthcoming amendment to the PD and DA sections of the Zoning Ordinance or amend any aspect of the PD or DA process in addition to the changes already proposed by staff, staff seeks direction from the Council.

Recommendation:

It is recommended the Council discuss the matter and give direction as deemed appropriate.

ITEMS TO BE PLACED ON FUTURE AGENDA:

 

ITEM NO. 2 - PROCESS FOR AMENDING DEVELOPMENT AGREEMENTS:

 

  • The Council did not support separating the Planned Development and Development Agreement requirements;
  • The Council supported formalizing the substantial conformance process by adding a process to the Code, which would include increased public notice and notification to the Council and Planning Board, with the ability for the Council/Board to appeal/call up the Director's decision. The Council also expressed desire for the Conditions of Approval for future Planned Developments to set clear parameters for substantial conformance to provide guidance to the Director in making conformance findings;
  • The Council supported using overlay zones or some alternative Planned Development zoning process such that when a project does not get built, the Planned Development zoning reverts back to the underlying zoning in place before the Planned development was approved;
  • The Council requested fully dimensioned and detailed plans as part of the application package accurately showing all details, including sidewalks and landscaping; and,
  • The Council supported a community meeting requirement to seek community input and address community concerns prior to the public hearing process.
