On Tuesday, August 30, 2005, the City received the written resignation from Council Member Stacey Murphy, dated August 29, 2005.

In such situations, the Charter provides as follows:  �If any officer of the City . . . shall resign . . . the office held by such officer shall thereupon be declared vacant by a majority vote of the Council and shall thereupon become vacant.�  (Charter section 26(c).)

It is therefore recommended that the Council, adopt the resolution declaring the seat of Council Member Stacey Murphy vacant and direct staff to bring back the requisite documents and actions to provide for the filling of the vacant position.
