PURPOSE:

The purpose of this report is to request Council authorization for the City Manager to amend the Professional Services Agreement with Kimley-Horn and Associates to prepare a traffic impact analysis for a proposed restaurant development on the A-1 North property located at 2555 North Hollywood Way.

BACKGROUND & ANALYSIS:

On October 22, 2003, the City Manager entered into a Professional Services Agreement (PSA) with Kimley-Horn and Associates (KHA) for the preparation of a traffic impact analysis for a proposed restaurant development on the A-1 North property. At the time of this approval, the estimated cost of document preparation was $49,115.

As the traffic study progressed, the project description was revised several times by the applicant. Due to these revisions and the additional traffic analysis required, KHA requested an amendment to the original PSA in the amount of $22,050. The City Manager approved this amendment on October 19, 2004.  Per City Policy, any PSA in an amount of $75,000 or less may be approved by the City Manager.

In late 2004, the applicant further modified the project description. As a result of these modifications and the additional traffic analysis required, KHA requested a second amendment to the PSA in the amount of $5,950, bringing the total amount of the contract to $77,115. Per City policy, any PSA in excess of $75,000 requires City Council approval. The City Council approved this amendment on January 25, 2005.

Since the most recent amendment, the applicant has requested that KHA conduct analysis on several project scenarios. These scenarios are outside of KHA�s current scope of work. As such, KHA has requested a third amendment in the amount of $6,450, bringing the total amount of the contract to $83,565.  This, again, required City Council approval to amend the contract.

FISCAL IMPACT:

No costs will be incurred by the City by amending the PSA with KHA. The applicant will be required to deposit an additional $7,095 to the City before the amendment is signed by the City Manager.  The City of Burbank�s fee resolution requires that applicants pay the cost of the amendment plus 10% (PSA amount of $6,450 plus 10% is $7,095).  If costs are at any time to exceed these amounts, the applicant will again be required to pay the full amount to the City (plus 10%) before work will continue on the environmental analysis.

RECOMMENDATION:

Staff recommends that the City Council adopt a resolution authorizing the City Manager to amend the Professional Services Agreement with Kimley-Horn and Associates to prepare a traffic impact analysis for the proposed restaurant development on the A-1 North property, located at 2555 North Hollywood Way.
