SUBJECT: RESOLUTION APPROVING CONTRACT DOCUMENTS AND AWARDING A CONSTRUCTION CONTRACT FOR THE PARTIAL FINAL CLOSURE OF THE FRONT FACE AREA OF Burbank Landfill No. 3 - Bid Schedule No. 1175


Purpose:

 

To request Council approval of contract documents and award of a construction contract for Bid Schedule No. 1175, Partial Final Closure of the Front Face Area of Burbank Landfill No. 3.

 

Background:

 

The Burbank Landfill No. 3 is a Class III, non-hazardous waste landfill located within an unnamed canyon in the northern portion of the City.  The landfill is regulated under  several permits issued by the Los Angeles Regional Water Quality Control Board (RWQCB), the California Integrated Waste Management Board, the South Coast Air Quality Management Board, and the County of Los Angeles Department of Health Services.  The landfill also operates under Conditional Use Permit (CUP) No. 2000-16, approved by the City of Burbank Planning Board Resolution No. 2802 on November 13, 2000.

 

In compliance with the landfill�s permits, filled areas that have reached final grade are to be covered with soil and vegetated to blend with the surrounding terrain.  The front slope (face) of the landfill located adjacent to Bel Aire Drive, has reached final grade and is now ready for final closure (the remainder of the landfill will continue to operate, having an estimated 50- to 60- years of refuse capacity). 

 

In December 2003, staff submitted a Partial Final Closure and Postclosure Maintenance Plan to the RWQCB.  The plan, which provided details about the design of the final cover, was approved by the RWQCB in September 2004.  The final cover for the front face consists of an alternative evapotranspiration (ET) cover comprised of 4-foot-thick monolithic soil layer planted with native, drought resistant vegetation.  This alternative cover represents a significant cost savings over a traditional cover design (estimated to cost around $600,000) while still providing the same environmental protections. A portion of the 2002 Series B Waste Disposal Revenue Bonds were earmarked for this project, which was included in the 2004-2005 Capital Improvement Program Budget.

 

Analysis
 

Bid Schedule No. 1175 was advertised in the Burbank Leader on January 19, 2005 and January 22, 2005.  Four copies of the bid were provided to potential bidders.  A mandatory job walk was held on January 24, 2005, which was attended by representatives from two contractor�s firms. 

 

On February 15, 2005, Lee Construction Company submitted the only bid of $357,791.50 (Exhibit A), which is approximately 52% higher than the engineer�s estimate of $235,010, yet significantly below the originally budgeted amount of $600,000 for a traditional landfill cover. Upon analysis, staff concluded that the current boom in the construction industry contributed to the higher than expected bid price.    Staff recommends moving ahead with the project rather than postponing it in order to remain in compliance with the facility�s permits.

 

Staff contacted the State of California Contractor�s State License Board and has found Lee Construction Company�s license to be current, active, and in good standing.  Staff also contacted several references, which provided confirmation that Lee Construction Company had satisfactorily completed their projects.  In addition, Lee Construction Company has completed several other projects for the Public Works Department with satisfactory results.

 

Construction of this project is planned to occur between April and May, 2005.  This project is an element of the overall and ongoing landfill operations for which a mitigated negative declaration was adopted as part of Conditional Use Permit No. 2000-16.

 

CALIFORNIA ENVIRONMENTAL QUALITY ACT ANALYSIS

 

An Initial Study and Mitigated Negative Declaration dated October 5, 2000 were prepared in accordance with the provisions of the California Environmental Quality Act (Public Resources Code Section 21000, et seq., hereafter "CEQA"), the State CEQA Guidelines (Title 14 Code of California Regulations Section 15000, et seq.) and the City's CEQA procedures (Burbank Municipal Code Sections 21-101, et seq.).

 

The Planning Board of the City of Burbank, at its regular meeting of November 13, 2000 held a public hearing on Project No. 2000-16, a Conditional Use Permit (a request from by the Burbank Public Works Department to renew CUP 85-19) and approved the Mitigated Negative Declaration as part of the Conditional Use Permit.

 

It is requested that the City Council consider the Mitigated Negative Declaration and find that this project is consistent with the analyzed project in the 2000 MND approved by the Planning Board as part of Conditional Use Permit No. 2000-16. The Initial Study and MND and CUP 2000-16 are on file in the office of the City Clerk.

 

Fiscal Impact:

 

Funding for this project is provided by the 2002 Series B Waste Disposal Revenue Bonds, and sufficient funding is available in Account No. 498.PW31B.15012.000.13645.  The cost of this project was included in the Refuse Fund�s 2004-2005 five-year financial forecast and will not cause a rate increase. 

 

Recommendation:

 

Staff recommends that Council adopt the resolution approving the contract documents and awarding a construction contract to Lee Construction Company for Bid Schedule No. 1175, Partial Final Closure of the Front Face Area of Burbank Landfill No. 3.
