� ADDENDUM TO COUNCIL AGENDA CITY OF BURBANK TUESDAY, OCTOBER 4, 2005 6:30 P.M.
REPORT:
14. Ratification of the Director of Emergency Services' Disaster Proclamation due to the hillside fires and Review of the Local Emergency:
On Thursday, September 29, 2005, the Director of Emergency Services proclaimed a local emergency due to the fire in the hills of the City. Pursuant to Burbank Municipal Code (BMC) Section 10-106, the Director of Emergency Services, the City Manager, has the authority to proclaim a local emergency when the Council is not in session.
BMC Section 10-102 defines an emergency as an ��actual or threatened existence of conditions of disaster or of extreme peril to the safety of persons and property within the City caused by such conditions as � fire�which conditions are or are likely to be beyond the control of the services, personnel, equipment and facilities of this City, requiring the combined forces of other political subdivisions to combat.�
In accordance with Government Code Section 8630, a proclamation by the Director of Emergency Services remains in effect for seven days unless ratified by the governing body. This action seeks the Council�s ratification of the proclamation.
Additionally, the Council is required to review the local emergency at least every fourteen days, unless the local emergency is terminated. Should the emergency be terminated prior to the Council meeting, then resolution will be amended to include a proclamation of the termination of the local emergency.
Recommendation:
Adoption of proposed resolution entitled: A RESOLUTION OF THE COUNCIL OF THE CITY OF BURBANK CONFIRMING THE PROCLAMATION OF THE EXISTENCE OF A LOCAL EMERGENCY BY THE DIRECTOR OF EMERGENCY SERVICES.
