PURPOSE: The purpose of this report is to request Council authorization for the City Manager to amend the Professional Services Agreement (PSA) with Christopher A. Joseph and Associates to prepare a subsequent environmental impact report for a proposed amendment to Planned Development No. 89-7 (�Media Studios North�).
BACKGROUND & ANALYSIS: On January 13, 2004, the City Council authorized the City Manager to enter into a PSA with Christopher A. Joseph and Associates (CAJA) for the preparation of a Subsequent Environmental Impact Report for a proposed Amendment to Planned Development No. 89-7 (�Media Studios North�). At the time of this approval, the estimated cost of document preparation was $78,505.
Based upon a more detailed project proposal provided by the applicant, CAJA has requested to increase the contract by $17,000. This increase is predominantly the result of additional costs associated with the preparation of a traffic study for the project. City Council approval is required to amend the PSA because the increase exceeds ten (10) percent of the original contract cost.
FISCAL IMPACT: No costs will be incurred by the City by amending the PSA with Christopher A. Joseph and Associates. The applicant will be required to deposit an additional $18,700 to the City before the amendment is signed by the City Manager. The City of Burbank�s fee resolution requires that applicants pay the cost of the amendment plus 10% (PSA amount of $17,000 plus 10% is $18,700). If costs are at any time to exceed these amounts, the applicant will again be required to pay the full amount to the City (plus 10%) before work will continue on the environmental analysis.
RECOMMENDATION: Staff recommends that the City Council adopt a resolution authorizing the City Manager to amend the Professional Services Agreement with Christopher A. Joseph and Associates to prepare a Subsequent Environmental Impact Report for the proposed amendment to Planned Development No. 89-7.
