SUBJECT:

A RESOLUTION AMENDING THE FISCAL YEAR 2003-2004 BUDGET APPROPRIATING FUNDS IN THE AMOUNT OF $40,000 FOR LITIGATION COSTS.

PURPOSE

 

On April 6, 2004 the City Council authorized the City Attorney�s Office to file a lawsuit against Kajima Construction Services and WLC Architects relating to construction defect issues at the Police/Fire Headquarters.  The purpose of this resolution is to amend the Fiscal Year 2003-2004 Budget to appropriate funds into the litigation account to cover the anticipated costs of the litigation.  These costs would include the costs of discovery and expert fees.

 

FISCAL IMPACT

 

$40,000 will be appropriated from retained earnings to the City Attorney litigation account for the anticipated costs of the litigation as noted above.

 

RECOMMENDATION

 

Staff recommends the City Council adopt the proposed Resolution.
