PURPOSE:
To request City Council approval of fee revisions for the Burbank Police Department and an amendment to the Fiscal Year (FY) 2003/04 City of Burbank Fee Schedule.
BACKGROUND/ANALYSIS:
As part of the FY 2003/04 budget process the Police Department reviewed the fee schedule to determine if all applicable areas were up to date. Those areas that were not current were revised when the budget was approved. After budget approval, the department continued to review areas to make sure all costs were appropriate. The following fees have been reviewed and we would request that they be revised or added to the fee schedule:
Article IV-Shelter Fees
Impounding: Section 1 (A) � Revised Fee Language
Dog � We would request that an asterisk be placed behind each amount for dog impounding with a footnote stating that a state surcharge will be added to this fee per the California Food and Agricultural Code, Section 30804.7. The shelter has been charging this fee per State law, but it has not been reflected in the fee schedule.
Article V � Public Safety
Miscellaneous Police Services: Section 8 (E) � Revised Fee Language
Firearm Storage Fee � We would request that language be revised to state that firearm storage fees are payable upon delivery. After putting this fee in place we realized that it would be difficult to collect fees since many people do not return to pick up their items. Therefore, we would request that City Council allow us to collect the money up front or bill individuals based on the time period for storage indicated by the court.
Miscellaneous Police Services: Section 8 � New Fee
Police Shooting Range Fees: These are new fees that outside agencies will be required to pay for use of the Police Shooting Range in Wildwood Canyon. Currently other agencies use our facility at no charge. We would request the following two categories for this fee.
Law Enforcement Range Use During Normal Range Hours � This fee would apply to law enforcement agencies that use the range during normal range hours (Mondays and Fridays 5:00 p.m. to 11:30 p.m. and Tuesdays, Wednesdays and Thursdays from 10:00 a.m. to 4:30 p.m.). Based on information received from other agencies, we would recommend that the charge be $10 per officer, per day, maximum three attempts to complete the course. If an officer is unable to complete the course in three attempts, he/she will be able to continue shooting for an additional $10 dollars per each three attempts. Prior to shooting, agencies will be required to sign a usage agreement, which has been developed by the City Attorney�s Office and will be kept on file at the Shooting Range. Ammunition and cleaning supplies will not be supplied by the City of Burbank.
Range Use Outside Normal Range Hours � This fee would apply to any approved group that requests the use of the range on a day it is closed. Range use would be for a minimum of four hours with an additional fee for each additional hour. Once again, agencies would be required to sign a usage agreement prior to use. Ammunition and cleaning supplies will not be supplied by the City of Burbank. We would recommend a cost of $400 for four hours to incorporate the Use of City Property fee ($200) already established in the fee schedule, plus the cost of labor ($50 per hour for four hours). A $50 fee for each additional hour will also be implemented to cover the cost of the Senior Rangemaster Armorer who would be required to be present for safety issues.
FISCAL IMPACT:
The revised language for the Shelter Fees and the Miscellaneous Police Services should not have an affect on our original revenue estimates. However, the creation of Police Shooting Range Fees should increase our revenues by approximately $7,500 a year, based on our current usage.
RECOMMENDATION:
Staff is recommending that the City Council approve the proposed Police Department fee revisions and amend the Fiscal Year 2003/04 Fee Schedule.
