A regular meeting of the Council of the City of Burbank was held in the Council Chamber of the City Hall, 275 East Olive Avenue, on the above date.  The meeting was called to order at 5:34 p.m. by Mr. Laurell, Mayor.

Airport Authority

Meeting Report

Commissioner Brown reported on the Airport Authority (Authority) meeting of Tuesday, January 21, 2003.  He stated the Authority unanimously approved the minutes for the meetings on December 4, December 16 and December 30, 2002, and the Treasurer�s Report for October and November 2002.  He also reported that a contract for airport sign upgrades was awarded to Lauren Electrical Sign Corporation of Montebello, the lowest bidder, in the amount of $94,639.50, noting the first part of the project would begin immediately and be completed within 90 days, and the rest of the airport would be updated when the construction at the terminal was completed.  Commissioner Brown also stated the Authority discussed the transfer of the operation of the Automated Surface Observance System to the Federal Aviation Administration at no cost to the airport and received an update on the terminal security enhancement project.  He also reported that the Commissioners did not discuss the upcoming trip to Washington, D.C. since they did not receive a copy of Burbank�s Discussion Paper and stated this issue would be discussed at an upcoming meeting on Monday, January 27, 2003.  Lastly, he commented on a public hearing on the proposed removal of the crosswalk at the Zelman Project, noting the Authority voted 6-3 to remove the crosswalk in question with the three Burbank Commissioners voting against the removal.

 

Mr. Golonski referenced a report by the Plan Evaluation and Review Committee (PERC) that recommended the Airport Authority address air quality issues, in particular, using compressed natural gas (CNG) buses and shuttles.  He stated the Authority did not deem the recommendation economical, but requested that the Commissioners revisit the pollution issue and consider Air Quality Management District (AQMD) grants to acquire CNG vehicles.  Commissioner Brown affirmed that the matter would be brought before the Authority at their next meeting, and Mr. Feng, Public Works Department Director, clarified that City Staff was already working with Commissioner Wiggins to apply for a grant for alternative fuel vehicles.

Appearing to comment were Curtis Hermann, in opposition to the proposed bow and arrow ordinance, stating the sport is compatible with other sports practiced in the Verdugo Mountains, and noting all bowhunters carry water, nutrition and a first-aid kit to render aid to anyone who needs it; Joe Gonzales, Assistant Chief, Department of Fish and Game, in support of the practice of archery in the Verdugo Mountains, requesting that the Council reconsider the proposed ordinance, citing the lack of accidents relative to bow and arrow hunting in the Verdugo Mountains, stating the current restrictions are sufficient to guarantee safety, referencing a copy of a letter submitted by Regional Manager C. F. Raysbrook, in support of bowhunting, stating a ban on bowhunting will have several detrimental effects, and that the Department of Fish and Game would be willing to assist with the criteria to issue permits as does the City of Glendale, if the Burbank Council desired to pursue that avenue; Jack Jonathan, stating archery is a safe sport, and suggesting the Council visit an archery range to determine the safety of the sport; Jerry Maytum, in disagreement with statistics presented by the Police Department regarding the number of deer taken in the Verdugo Mountains; Craig Fritz, Second Vice President of California Bow Hunting, reiterating the average shot in bowhunting is only 30 yards or less, and noting the existing City law allows for 300 feet, adding they have not recorded accidents in 60 years in the Verdugo Mountains, requesting the �NO HUNTING� signs which pertain to the use of firearms be replaced with signs explaining that bowhunting is allowed in the Verdugos, that his organization would help in the funding of such signs and suggesting a sign-in and sign�out system to better control people in the area; Tim Atwood, National Field Archery Association, stating his organization is in agreement with the position of the California Department of Fish and Game, stating archery is an ideal way to cull the deer herd in the Verdugos;

 

R. C. "Chappy" Czapiewski, reading from the Brown Act and commenting on the intent of the legislature; Mark Barton, in opposition to the current system of oral communications; Garen Yegparian, in opposition to the proposed ordinance banning bowhunting within City limits, suggesting public education with regard to the activity, and citing statistics to support his position; David Piroli, stating Commissioner Brown failed to mention the discussion regarding the consequences of the Federal Aviation Administration not sending a high-ranking individual to hold a public meeting in Burbank, in opposition to the proposed bowhunting prohibition, and commenting on clarification of the term �action items� as it relates to the second period of oral communications; and C.L. Stack, agreeing with Mr. Piroli�s comments on oral communications.

Clarification of

Second Period

Of Oral

Communications

Mr. Barlow, City Attorney, stated this matter was agendized at the request of Mayor Laurell, for Council consideration of possible amendment to the rules restricting speakers at the Second Period of Oral Communications to �action items� only as opposed to �agenda items� as currently allowed.  He noted the Brown Act provides members of the public may speak on items to be considered by the Council before action is taken, adding staff requested direction on whether to do further work and present a change in that regard. He noted that inclusion of language regarding action items would preclude Closed Session items, as there is an oral communications period prior to Closed Session, and in addition, members of the public can comment on Closed Session items during the First and Third Periods of Oral Communications.

It was moved by Mr. Golonski and seconded by Ms. Murphy that "staff be directed to come back with the necessary language to restrict the Second Period of Oral Communications to action items and items on the Closed Session agenda.�

Teen TV Show

Pilot Series

Mr. Mike Flad, Park, Recreation and Community Services (PRCS) Director, gave a presentation seeking Council authorization for a one-time funding allocation for a Teen Television Show Pilot Series in the amount of $64,200. He gave a brief history on the teen survey, the Burbank Youth for Youth Summit, and stated recommendations made during the summit included the proposed Teen Television Show Pilot Series. He stated the Teens in Action Committee, comprised of middle and high school students from public and private schools in Burbank, is currently working on infusing teens into City programs, specifically Chalk Talk, Street Beat and public service announcements, with future projects including a teen format website and print materials. 

 

Mr. Flad added the first episode of the pilot series would be aired in the next 30 to 60 days, followed with four additional shows. He affirmed that the overall target was to reach hard-to-reach teens and to address and increase knowledge of teen issues in the community. After the first episode, focus groups would be conducted for input from the teens regarding the name, content, length and the different segments on the show. Staff would then continue to modify each episode, so that by the end of the program an idea of what the teens are looking for and how the City can better meet their needs will be identified and the evaluation will be presented to the Council. He also added staff is working with the community for more in- kind donations to reduce the equipment cost. He concluded with the recommendation of the Mayor�s Youth Task Force, PCRS Board, Public Information Office Sub-Committee and the Teens in Action Committee that the Council approve this project.

 

Council discussion included the marketing strategy and Mr. Flad clarified there was a marketing sub-committee looking at ways to market the show outside Channel 6, and that the focus groups after the first episode would further address marketing strategies. Mr. McManus, Public Information Officer, also added that marketing strategies being considered by the teens included T-shirts, newsletters, audio announcements and school television broadcasts.

 

Mrs. Ramos expressed concern about the use of the equipment in the event that the City could not continue to fund the pilot series. Mr. McManus advised that the equipment to be purchased would all be broadcast quality. He also stated the budget estimate was on the higher side and he believed the cost per episode could be brought down by approximately $2,000.

It was moved by Ms. Murphy and seconded by Mr. Golonski that "the Council approve the one-time expenditure of $64,200 from the Non-Departmental Holding Account for implementation of the Teen Television Show-Pilot Series.�

Prohibit Shooting

of Bow and

Arrows within

City Limits

Captain Skvarna, Burbank Police Department, Investigation Divisions Commander, reported that the Council had requested additional information on the neighboring cities� regulations regarding archery and bowhunting within city limits as well as information regarding deer herd management.  He stated the Cities of Pasadena and LaCanada Flintridge did not permit bowhunting within their city limits, the County of Los Angeles allows bowhunting, and the City of Los Angeles did not permit hunting or discharging a bow and arrow on other than an archery range or on recreation or park lands, but was not able to verify that information.  Captain Skvarna also reported that the City of Glendale allowed bowhunting with a permit issued by the Police Department.  He acknowledged the concern that bowhunting is a vehicle by which to manage the deer herd and keep the deer from encroaching on settled areas.  However, he noted that reports showed no deer had been taken in the 2001-02 hunting season, though hunters were sometimes remiss in turning in their tag information.  He concluded the Police Department still believed there was a safety issue if bowhunting is allowed in an area that is frequented by other members of the public. 

 

Mayor Laurell asked for clarification on the criteria used by the City of Glendale in issuing bowhunting permits and also asked if it was possible to implement a permitting procedure. Captain Skvarna stated the Glendale Municipal Code did not provide any specific procedure and Mr. Barlow, City Attorney, informed the Council of the possibility of implementing a permitting procedure.  Captain Skvarna added that the Department of Fish and Game limited the number of permits issued within a hunting season. 

 

Mr. Joe Gonzalez, Assistant Chief, Department of Fish and Game, was asked to clarify the issuance of a Depredation Permit and he reported this permit was issued when wildlife encroached on private land, caused damage and the Department of Fish and Game could not eliminate or identify the attractive nuisance.  

 

Mayor Laurell inquired about the criteria used by any municipalities or counties issuing bowhunting permits and Mr. Gonzales explained that the State currently requires 10 hours of hunter education, and an additional 15 hours of bowhunting classes.

 

Mr. Vander Borght asked Ms. Barboza, Department of Fish and Game Biologist, about the need for hunting for purposes of herd management.  She stated the department did not have specific data regarding this local herd, due to lack of documentation from the deer report cards on the exact location where the deer were taken.  However, she noted the extremely prolific nature of mule deer, which are capable of doubling and tripling their population easily, and stated a small change in the equilibrium could easily cause a huge effect on the deer population causing an increase in deer/human conflicts ranging from property damage to vehicle collision, and an increase in predator/human conflicts since coyote follow deer into backyards. She concluded that if bowhunting is prohibited, an effective way to manage the deer herd will be eliminated.

Appearing to comment were David DeVille, questioning the origin of the bowhunting ordinance, reiterating that the information presented by the bowhunters and the Department of Fish and Game, who are the experts in the field, far outweighed the presentation of the Police Department, and requesting the Council reconsider their decision; Esther Espinoza, inquiring about the activities held in Burbank in honor of Martin Luther King Day, commenting on a housing shortage for low to moderate income households; Dink O�Neal, commenting on improvements at the 5-points intersection and expressing appreciation to the Public Works Department; David Piroli, commenting on Council deliberations on clarification of the second period of oral communications, and the effect of the Governor�s proposed business taxes on the issue of Runaway Production; Mark Barton, commenting on Council deliberations on clarification of the second period of oral communications, and requesting the Empire Interchange project be expedited; and Mike Chapman, President of Starlight Hills Neighborhood Group, stating a significant number of residents in their group were in support of the ban on bowhunting, and expressing appreciation to the Council for passage of the ordinance.
